Right of action: Under reforms that took effect in June 2025, individuals may also have a direct right to take legal action for serious invasions of privacy under the Privacy Act 1988 (Cth).
Notifiable Data Breaches
The Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth) requires eligible organisations to notify the OAIC and affected individuals when a data breach is likely to cause serious harm.
The Med Collective Pty Ltd is currently below the $3 million annual turnover threshold that triggers mandatory NDB obligations for private sector organisations. However, we take data security seriously and, in the event of a breach involving personal information, we will assess the circumstances and take appropriate action — including notifying affected individuals and the OAIC where warranted. Please note: the small business exemption under the Privacy Act is subject to proposed reforms. We will update this policy if our obligations change.
